Terms of Service for

These Terms of Service (“Terms”) govern Your access to and use of the DreamSlip Ascent application and related services (the “Service”) operated by DreamSlip Pty Ltd (“Company”, “We”, “Us”, or “Our”).

By accessing, registering for, or using the Service, You agree to be bound by these Terms. If You do not agree to these Terms, You must not access or use the Service.

These Terms should be read together with Our Privacy Policy, which explains how We collect, use, and protect Personal Data.

 

1. Acceptance of Terms​

By accessing or using the Service, You confirm that:

  • You have read and understood these Terms, and

  • You agree to comply with them in full.

If You are using the Service on behalf of a company or other legal entity, You represent that You have authority to bind that entity to these Terms.

2. Eligibility and Age Requirement (16+)​
​

You may only access or use the Service if You are at least 16 years of age.

By using the Service, You represent and warrant that:

  • You are 16 years of age or older, and

  • You have the legal capacity to enter into binding agreements under applicable law.

The Service is not intended for use by individuals under the age of 16. We do not knowingly permit registration, account creation, or use of the Service by anyone under 16.

If We become aware that an account has been created or Personal Data has been collected from an individual under 16, We will take reasonable steps to suspend or terminate the account and delete associated data, in accordance with Our Privacy Policy.

 
3. Accounts and Registration​

To access certain features of the Service, You may be required to create an Account.

You agree to:

  • Provide accurate, current, and complete information

  • Keep Your Account information up to date

  • Maintain the confidentiality of Your login credentials

We reserve the right to refuse registration, suspend accounts, or terminate access where We reasonably believe these Terms have been breached.

  • Interfere with or disrupt the Service or its infrastructure

  • Attempt to gain unauthorised access to systems or data

  • Upload or transmit malicious code or harmful content

  • Impersonate another person or misrepresent Your identity

We reserve the right to investigate and take appropriate action in response to misuse of the Service.

 

5. Content and User Submissions​

You may be able to submit, upload, or share content through the Service (“User Content”).

You retain ownership of Your User Content. However, by submitting User Content, You grant Us a non-exclusive, worldwide, royalty-free licence to use, host, reproduce, modify, display, and distribute such content solely for the purpose of operating, improving, and promoting the Service.

You represent that:

  • You own or have the necessary rights to submit the content

  • Your content does not infringe the rights of others

  • Your content complies with applicable laws

We reserve the right to remove or restrict access to User Content that violates these Terms or applicable law.

 

6. Intellectual Property​

The Service, including its software, design, features, branding, and content (excluding User Content), is owned by or licensed to the Company and is protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal or authorised business use, subject to these Terms.

You must not:

  • Copy, modify, or distribute the Service

  • Reverse engineer or attempt to extract source code

  • Use Our trademarks without prior written permission

 

7. Third-Party Services and Links​

The Service may integrate with or link to third-party services, platforms, or websites.

We do not control and are not responsible for third-party content, services, or practices. Your use of third-party services is governed by their own terms and policies.

 

8. Fees and Payments (If Applicable)

Certain features of the Service may be offered for a fee.

If You purchase paid features, You agree to:

  • Pay all applicable fees as described at the time of purchase

  • Provide accurate billing information

Unless otherwise stated, fees are non-refundable to the extent permitted by law.

 

9. Suspension and Termination

We may suspend or terminate Your access to the Service at any time, with or without notice, if We reasonably believe that:

  • You have breached these Terms

  • Your use poses a security, legal, or reputational risk

  • The Service is required to be modified, withdrawn, or discontinued

You may stop using the Service at any time. Termination does not affect accrued rights or obligations.

 

10. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, We disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted or error-free

  • Defects will be corrected

  • The Service will meet all Your requirements

 

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, consequential, or special damages

  • Our total liability arising out of or relating to the Service is limited to the amount You paid to Us (if any) in the 12 months preceding the claim

Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law.

 

12. Indemnity

You agree to indemnify and hold harmless the Company, its directors, officers, employees, and partners from any claims, damages, losses, or expenses arising from:

  • Your use of the Service

  • Your breach of these Terms

  • Your violation of applicable laws or third-party rights

 

13. Privacy

Your use of the Service is subject to Our Privacy Policy, which forms part of these Terms. By using the Service, You consent to the collection and use of Personal Data as described in that policy.

 

14. Changes to the Service and Terms

We may update or modify the Service or these Terms from time to time.

Where changes are material, We will provide reasonable notice through the Service or by other means. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

 

15. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia.

You agree that any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of New South Wales.

 

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
 

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between You and the Company regarding the Service and supersede any prior agreements or understandings.
